Terms and Conditions

 

For the purposes of these Terms and Conditions, Fusion Connect refers to Fusion Connect, Inc. and its subsidiaries.  By participating in the Champions Club Promotion (“Promotion”), participants agree to be bound by the following Contest Rules and Terms and Conditions:

Contest Rules:

  • Contest dates: July 1 - September 30, 2025
  • Eligibility Minimum:  $10,000 net new MRR in the contest window
  • Winners:  Top 3 MRR generating partners
  • Prize Selection: One prize per qualifying partner
  • MRR Definition:  Net new, signed deals within contest period
  • One prize per organization
  • TSDs are ineligible for this contest

Terms and Conditions:

1. Eligibility Verification

Participants must be 18 years of age or older at the time of entry. By participating in the Promotion, you represent and warrant that you meet this age requirement.  Fusion Connect reserves the right to verify the eligibility of all participants. Any misrepresentation or fraudulent activity may result in disqualification at the sole discretion of Fusion Connect. 

2. Qualifying Sales: “Net-new MRR” means monthly recurring revenue from contracts for new customers only signed during the promotion period.

3. Prize Conditions

Prizes are non-transferable and may not be substituted or redeemed for cash, except at the sole discretion of Fusion Connect. Fusion Connect reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

4. Taxes and Expenses

All federal, state, and local taxes, and any other costs and expenses associated with prize acceptance and use not specified herein, are the sole responsibility of the prize recipient. 

5. Disqualification

Fusion Connect reserves the right to disqualify any participant who violates these Terms and Conditions, or acts in a disruptive manner, in Fusion Connect’s sole discretion.

6. Limitation of Liability

Fusion Connect and its affiliates, officers, directors, employees, and agents shall not be liable for any damages, losses, or injuries of any kind resulting from participation in the Promotion or acceptance, possession, or use of any prize. 

7. Publicity

By accepting a prize, participants consent to the use of their name, likeness, and organization name for promotional purposes by Fusion Connect without additional compensation, unless prohibited by law.

8. Data Privacy

Participant information collected in connection with the Promotion will be used in accordance with Fusion Connect’s Privacy Policy. By participating, you consent to such use. 

9. Modification or Termination

Fusion Connect reserves the right to modify, suspend, or terminate the Promotion at any time for any reason, including but not limited to fraud, technical failures, or any other factor beyond its reasonable control.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Manhattan, New York.
